SECTION 12A - PRODUCT SAFETY DISCLAIMER AND LIMITATION OF LIABILITY

1. PRODUCT CHARACTERISTICS AND INTENDED USE

magnoid footwear is designed with slip-resistant outsoles to provide 
enhanced traction on common wet surfaces encountered during everyday 
activities. Our products are intended for general walking and daily 
wear in typical indoor and outdoor environments.

IMPORTANT: magnoid shoes are NOT:
   • OSHA-compliant safety footwear
   • Specialized protective equipment for hazardous workplaces
   • Designed to prevent all slips, trips, or falls under all conditions
   • A substitute for workplace-mandated safety equipment

2. PERFORMANCE LIMITATIONS

While our slip-resistant technology is effective under normal conditions, 
slip resistance is SIGNIFICANTLY REDUCED OR MAY BE INEFFECTIVE on:

   a) Surfaces contaminated with oil, grease, petroleum products, or 
      industrial lubricants
   b) Chemically treated or contaminated floors
   c) Ice, snow, or frozen surfaces
   d) Excessively worn, polished, or waxed flooring
   e) Surfaces with standing water deeper than the tread depth
   f) Loose gravel, sand, or unstable ground
   g) Any surface the manufacturer deems hazardous

These limitations are inherent to ALL slip-resistant footwear and are 
not specific to magnoid products.

3. USER RESPONSIBILITIES

By purchasing and using magnoid products, you acknowledge and agree that:

   a) You will inspect your environment before relying on slip resistance
   b) You will maintain the footwear according to care instructions
   c) You will replace shoes when tread depth is visibly reduced
   d) You will NOT use the footwear in conditions you know to be hazardous
   e) You are solely responsible for assessing the suitability of the 
      footwear for your specific use case

4. MEDICAL CONSIDERATIONS

Individuals with the following conditions should consult a healthcare 
provider BEFORE relying on slip-resistant footwear:
   • Balance disorders or vertigo
   • Mobility impairments or gait abnormalities
   • Visual impairments affecting depth perception
   • Neurological conditions affecting coordination
   • Recent injuries affecting stability
   • Any condition requiring medical-grade assistive devices

Magnoid footwear is NOT a medical device and is NOT a substitute for 
proper medical treatment or assistive equipment.

5. EXPRESS DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

   a) Magnoid products are provided "AS-IS" and "AS-AVAILABLE"
   
   b) WE EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:
      • Implied warranties of merchantability
      • Fitness for a particular purpose
      • Non-infringement
      • Any warranties arising from course of dealing or usage of trade
   
   c) WE DO NOT WARRANT THAT:
      • The products will meet your specific requirements
      • The products will prevent slips, falls, or injuries
      • The products are suitable for any particular work environment
      • The products will perform under all conditions

6. LIMITATION OF LIABILITY FOR PERSONAL INJURY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AND SUBJECT TO SECTION 13 
(DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY):

Magnoid, its officers, directors, employees, agents, and affiliates 
SHALL NOT BE LIABLE for any injuries, accidents, losses, or damages 
of any kind arising from:

   a) Slips, trips, or falls while wearing Magnoid products
   b) Use of products on unsuitable or hazardous surfaces
   c) Failure to maintain products according to instructions
   d) Use of products beyond their intended lifespan
   e) Pre-existing medical conditions or physical limitations
   f) Failure to exercise reasonable caution
   g) Violations of workplace safety regulations
   h) Third-party actions or environmental conditions

This limitation applies regardless of the theory of liability (contract, 
tort, negligence, strict liability, or otherwise) and even if we have 
been advised of the possibility of such damages.

7. ASSUMPTION OF RISK

You expressly assume all risks associated with the use of Magnoid products, 
including but not limited to:
   • The risk that the products may not prevent slips or falls
   • The risk of injury from use in unsuitable conditions
   • The risk arising from your own actions or negligence

8. STATE-SPECIFIC LIMITATIONS

Some jurisdictions do not allow the exclusion or limitation of certain 
warranties or liabilities, particularly for personal injury or death 
caused by negligence. In such jurisdictions:
   a) The above limitations apply only to the maximum extent permitted 
      by law
   b) You may have additional rights that cannot be waived
   c) Nothing in this Section 12A limits liability that cannot legally 
      be limited

9. PRODUCT DEFECTS

This Section 12A does NOT limit Magnoid's liability for:
   a) Manufacturing defects that cause the product to fail to meet 
      published specifications
   b) Intentional misconduct or gross negligence by Magnoid
   c) Violations of applicable product safety regulations
   d) Any liability that cannot be excluded under applicable law

Claims for product defects must be made within 30 days of discovery 
with photographic evidence of the defect.

10. THIRD-PARTY RESPONSIBILITY

You acknowledge that slip prevention is a shared responsibility requiring:
   • Proper footwear (provided by Magnoid)
   • Adequate floor maintenance (responsibility of property owner/employer)
   • User awareness and caution (your responsibility)
   • Compliance with applicable safety regulations (all parties)

Magnoid is not responsible for third-party failures to maintain safe 
premises or comply with safety regulations.

11. ACKNOWLEDGMENT

BY PURCHASING MAGNOID PRODUCTS, YOU ACKNOWLEDGE THAT:

   ☑ You understand that no footwear can prevent all slips and falls
   ☑ You accept the risks and limitations described above
   ☑ You agree to use the products only for their intended purpose
   ☑ You will seek professional advice if you have medical concerns
   ☑ This disclaimer is an essential part of our agreement

products. Return unused products within our return period for a full

SECTION 13 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
We do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error-free.

You agree that from time to time we may remove the Service for indefinite periods of time or cancel the Service at any time, without notice to you.

In no case shall magnoid, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, Service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility.
